The Delhi High Court has issued a restraining order against Patanjali Ayurved, preventing the company from broadcasting advertisements that portray Dabur India's products in a negative or misleading light. The case was filed by Dabur, which argued that Patanjali's advertisements made disparaging comparisons between its own 'natural' products and Dabur’s, implying that Dabur's offerings were chemically harmful.
The court emphasized that comparative advertising is permitted, but misleading or disparaging claims are not protected under free speech, especially when they damage a competitor's reputation. Patanjali, known for its aggressive marketing of Ayurvedic products, has faced similar challenges in the past for making unverified claims.
The bench has directed Patanjali to pull down existing ads and refrain from future broadcasts that contain such content until the case is fully resolved. The decision sets a precedent for responsible advertising, especially in the competitive FMCG and Ayurvedic product sectors.
