The Supreme Court of India has summoned five stand-up comedians - Samay Raina, Nishant Tanwar, Sonali Thakar, Vipul Goyal, and Balraj Paramjeet Singh Ghai — over allegations of mocking persons with disabilities in their comedy performances. The summons follows a petition filed by disability rights advocates, claiming the comedians’ content was offensive and discriminatory, perpetuating harmful stereotypes.
Taking cognizance of the matter, the apex court emphasized the seriousness of mocking marginalized communities under the guise of humor. The court has directed the personal appearance of all five comedians in the upcoming hearing, signaling that such content may be in violation of laws protecting the dignity of persons with disabilities.
While the comedians are yet to issue formal responses, the case has sparked debate on the boundaries between freedom of expression and responsible humor, especially concerning vulnerable communities. The court is expected to examine whether their acts violated provisions under the Rights of Persons with Disabilities Act, 2016, or other relevant constitutional protections.
The next hearing is scheduled for later this month.
