IndiGo Airlines has initiated legal action against Mahindra Electric Automobile Limited (MEAL) in the Delhi High Court, alleging trademark infringement over the use of "6E" branding for Mahindra’s BE 6e electric SUV. The dispute centers on IndiGo’s claim that its trademark, widely recognized in aviation and passenger services, is being misused.
IndiGo’s trademark “6E” is central to its identity, featuring prominently in services like 6E Prime, 6E Eats, and 6E Flex. In a statement, IndiGo emphasized that its branding is globally recognized and integral to its reputation and goodwill. The airline insists any unauthorized use, including by Mahindra, infringes on its rights and creates confusion among consumers.
Mahindra, however, argues that its BE 6e branding is distinct and relates solely to electric vehicles. The company stated that its trademark registration, approved by the Registrar of Trademarks, is specific to Class 12 (vehicles) and does not conflict with IndiGo’s designation for aviation services. Mahindra has also sought to reassure stakeholders, asserting that its branding is uniquely styled and poses no risk of confusion with IndiGo’s services.
The legal proceedings, initially scheduled before Justice Amit Bansal, have been postponed after the judge recused himself. Both companies are currently engaged in discussions to resolve the matter amicably. Mahindra has acknowledged IndiGo’s concerns about potential goodwill infringement and expressed willingness to address them.
Under Indian trademark law, protections are typically limited to the categories under which a trademark is registered. However, exceptions exist for trademarks deemed “well-known” or where consumer confusion could arise. The outcome of this case may set a precedent for trademark enforcement across unrelated industries like aviation and automotive.
