The Supreme Court has issued a notice to the Election Commission of India in response to a petition challenging the Bihar government's Special Intensive Revision of voter lists. The petition raises a significant legal question: Can Aadhaar, which is not a citizenship document, be used to verify a citizen's eligibility to vote? The PIL, filed by social worker Devaki Nandan Jha, argues that asking for Aadhaar during the revision process is unconstitutional since the Aadhaar Act itself states that it is not proof of citizenship.
The Election Commission, however, has maintained that Aadhaar is being used voluntarily to weed out duplicate entries and improve the accuracy of the voter rolls. The plea also alleges that the Bihar government is effectively excluding marginalized voters by insisting on Aadhaar. The Supreme Court’s involvement may set a precedent in clarifying the role of Aadhaar in electoral processes. The case holds national significance ahead of upcoming elections, especially with concerns about fair representation and data misuse surfacing again.
