The U.S. Embassy in New Delhi has issued a stern warning to Indian visa holders following the recent controversy involving an Indian student being handcuffed at a U.S. airport. On June 10, 2025, the Embassy made it clear that it will not tolerate illegal entry, visa abuse, or any violation of U.S. immigration laws, reiterating that non-compliant travelers could face serious consequences.
This warning underscores two major points:
-
Illegal Entry & Visa Misuse
Under U.S. law (8 U.S.C. § 1325), unauthorized entry—such as entering at non-designated points, evading inspection, or using fraudulent documents—is a misdemeanor on the first offense, punishable by up to six months in jail or a fine; repeat offenses become felonies, carrying up to two years in prison. -
Visa Overstays & Fraud
Separate rules penalize overstaying or committing visa fraud. Overstayers may face deportation, registration mandates, and permanent bans from re-entering the U.S.
The Embassy’s warning serves as a strong reminder for prospective and current travelers to strictly adhere to visa terms, including authorized entry points, registration timelines, and law-abiding conduct. Failure to comply may result in criminal charges, deportation, and long-term restrictions on travel to the United States.
