The Supreme Court of India has taken a firm stand against insensitive humor, directing several comedians—including Samay Raina, Vipul Goyal, and others - to publicly apologize on their social media channels for jokes mocking persons with disabilities. During hearings on a petition by the Cure SMA Foundation, which advocates for families affected by spinal muscular atrophy, the bench asserted that commercialized speech must not hurt the sentiments of vulnerable communities .
Senior Advocate Aparajita Singh, appearing for the Foundation, informed the court that “good sense has prevailed” and all comics have tendered unconditional apologies in court. However, the court stressed that an apology must be delivered publicly - not just privately - ordering each comic to post a video apology on platforms like YouTube and report any penalties they’re willing to accept .
The Attorney General noted that the government is in the process of drafting broad-based guidelines for influencers and comedians to ensure sensitive, inclusive content. The court emphasized that any future framework must be proactive, not reactive, and informed by domain experts.
