In a significant move Australia’s online safety regulator eSafety has imposed a hefty fine of nearly $1 million (A$957,780) on the encrypted messaging app Telegram for its failure to meet the deadline to address serious online harms. Telegram was asked to report back in October 2022 on its efforts to combat terrorism and child exploitation material on its platform but the company took 160 days to respond-significantly delaying regulatory oversight.
esafety Commissioner Julie Inman Grant emphasized the importance of transparency from tech companies in preventing and addressing online harms. She noted that Telegram's delay obstructed eSafety’s ability to fulfill its duties under the Online Safety Act for months. The Australian government alongside the Five Eyes security agencies had previously linked Telegram to the spread of extremist content which has raised concerns about its role in radicalizing young viewers.
Telegram has expressed dissatisfaction with the fine calling it unfair and disproportionate and plans to appeal the decision. The company now has 28 days to challenge the fine seek an extension or pay the penalty. Telegram’s CEO Pavel Durov has faced legal issues globally including charges in France for failing to curb extremist content. In response Telegram has begun releasing transparency reports about its dealings with law enforcement, showing efforts to improve compliance with global regulations.
This action serves as a strong reminder of the growing pressure on tech companies to address online safety seriously, with eSafety warning that more such penalties could follow.
