After shocking SC comment, BJP MP may face contempt of court charges

A criminal contempt plea has been submitted to the Attorney General of India seeking action against BJP MP Nishikant Dubey for statements deemed derogatory toward the Supreme Court and Chief Justice of India, Sanjiv Khanna. According to the letter by an Advocate-on-Record, Dubey accused the court of pushing the country towards “anarchy” and held the Chief Justice responsible for “civil wars,” in reference to judicial timelines set for executive action on legislative matters.
Further controversy arose from Dubey’s remarks related to the Supreme Court’s intervention in petitions challenging the Waqf Amendment Act, which the petition claims were communally charged. The advocate emphasized that Dubey’s words were “dangerously provocative,” aimed at undermining the judiciary’s independence and inciting public unrest.
Filed under Section 15(1)(b) of the Contempt of Courts Act, the letter argues that such baseless allegations are an attempt to vilify the court and scandalize the judiciary’s highest office. If the Attorney General grants consent, criminal contempt proceedings may follow.
In response to growing criticism, BJP President JP Nadda distanced the party from Dubey’s statements, labeling them as his personal views and not reflective of the party’s stance.
